Terms, conditions and policy

Throughout this agreement “HomeManager” and its affiliates will be identified as HomeManager, Us, We, HM or Service Provider, with our service provided to you in the form of a web app, phone app or any other electronic communication. You, the “Member” will be identified as member, users, you, or Homeowner/s or recipient of our information.

Privacy :

We do not sell any of your information to third parties. Nor do we use your information to advertise products to you. We’re a digital resource information service for you and your family.

Security :

We use industry standard measures to protect against unauthorized access to your data. Members are responsible for keeping their Login ID and Password confidential, secure and private. Any breach of this access point by a user is the responsibility of the member.

Confidential Information :

We do not sell your individual information to anyone. Your information is on the cloud and available to you and who you authorize.                                  HomeManager shall not ask for, nor shall be responsible for storing, any Personally Identifiable Information or Protected Health Information under the Health Insurance Portability and Accountability Act.

Data protection :

All data is encrypted and stored in secure data centers.

Complaints :

As a membership service our main priority is your satisfaction. If at any time you have a concern, complaint or issue please contact us at customercare@homemanger.io or toll free at 833-466-3647.

Suggestions :

We welcome your ideas, suggestions and feedback. Have a question about maintenance just send us a chat. With everyone’s input we make HomeManager a great resource for everyone to use and learn from.

Terms :

Our service is a membership which you can terminate at any time. Members must be at least eighteen years old to sign up for our service, or, if a higher age of contractual capacity exists in your jurisdiction, then you must be at least that age.

Data, Information, Advice :

Our information is provided to you for your review. We gather this data and information from volunteers, advisors, government agencies, and experts in the industry. We are merely an information resource for our members. As we compile all this information, we condense it into an opinion data source for our members. We do not recommend in any way, process, person, entity or business to use. You do so at your own risk. We do not advise, consult or refer anyone or any branded products. We aggregate information from other members and users. That data is shared with all members to review. We suggest our members review our data and make their best judgement on how to proceed and if additional understanding is needed, we suggest you consult experts in the industry. Our service is meant to save our members time and money by getting information quickly. All data and general information as in HomeTeams, product manuals, and maintenance data uploaded to HomeManager becomes the property of Home Manager. We do not share individual’s private data only the information listed above.

Passwords and signup :

As part of becoming a HomeManager member we will ask you to sign up and register as a user. We require you to use a current and active email for the registered name. Once completed we will then ask you to create a password. You are responsible for keeping your login and password private and confidential. We will not be responsible or liable for any loss or damage to your account because of an unauthorized use of your account. If you use a third-party site, like Facebook or other third-party site to engage with HomeManager we cannot be responsible for any breach of security through their site.

Registered members :

You agree that the information you input will be true and correct and will not harm anyone or other members.

Professionals :

The appearance of a certain professional should not be construed as being recommended or referred by HomeManager. We are merely showing who other members may be using. We suggest that you check them out prior to using and make sure if needed that they are licensed, bonded and insured prior to using their services.

Age of Use and eligibility :

Anyone over eighteen can become a member if they own, rent or have a legal interest in a home with a legal address. We do not request information from minors unless the Fair Housing or individual State and Federal regulations requires it to provide housing for underaged recipients. If this applies, we might ask for a waiver from the requesting agency for our files.

Disclaimers, warranties and indemnification :

HomeManager is not responsible for any illegal hacking, software glitches or errors caused by third party hackers into our system. We further disclaim all warranties, expressed, or implied regarding the user content, use of the content or any information that a user has been harmed by. We provide no warranty, warranties, assurances for any information or users of the site. Any Professionals that are used through the site are done at the users own risk.

Points and Prizes :

All prizes under any contest or giveaway by HomeManager are awarded by HM guidelines and subject to Montana State rules, regulations, conditions and statutes. Any taxes will be the responsibility of the recipient. HomeManager has no responsibility of taxes, usage, or risks of using any prizes selected by members. Expiration of any prizes will be outlined on the HomeBoard under prize and points information.

Termination :

We reserve the right, in our sole discretion, to restrict, suspend, or terminate this Agreement and your access to all or any part of the Service, at any time and for any reason without prior notice or liability. We reserve the right to change, suspend, or discontinue all or any part of the Service at any time without prior notice or liability.

Subscribe and unsubscribe :

At any time you wish to unsubscribe just click on the unsubscribe button and follow the process to unsubscribe.

Member Transfer :

If a member sells their home and purchases another home, they should contact Customerservice@Homemanager.io and request a transfer of membership, however they must release their previous property so a new owner can claim. Some information that has been stored in HomeManager may be forwarded to the current property owner. All stored information will be available to members property for their use only.

Intellectual Property :

HomeManager contains material, such as software, text, graphics, images, sound recordings, audiovisual works, and other material provided by or on behalf of HomeManager (collectively referred to as the “HomeManager Content”). The HomeManager Content may be owned by us or by third parties. The HomeManager Content is protected under both United States and foreign laws. Unauthorized use of the HomeManager Content may violate copyright, trademark, and other laws. We give you permission to use the aforementioned content for personal, non-commercial purposes only and do not transfer any intellectual property rights to you by virtue of permitting your use of the website or the Service. You may print, download, and store information from HomeManager for your own convenience, but you may not copy, distribute, republish (except as permitted in this paragraph), sell, or exploit any of the content, or exploit the Service in whole or in part, for any commercial gain or purpose whatsoever except as expressly provided herein. You must retain all copyright and other proprietary notices contained in the original HomeManager Content on any copy you make of the HomeManager Content.

Indemnification :

You agree to defend, indemnify, and hold us and our officers, directors, employees, successors, licensees, stockholders and assigns harmless from and against any claims, actions, or demands, including, without limitation, reasonable legal and accounting fees, arising or resulting from your breach of this Agreement or your access to, use, or misuse of the HomeManager Content, the Website, or the Service. We shall provide notice to you of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit, or proceeding. We reserve the right to assume the exclusive defense and control of any matter that is subject to indemnification under this section. In such case, you agree to cooperate with any reasonable requests assisting our defense of such matter.

Limitation of Liability :

Under no circumstances shall HomeManager or any of its respective employees, directors, officers, agents, vendors stockholders or suppliers be liable for any direct or indirect losses or damages arising out of or in connection with the use of or inability to use the site. This is a comprehensive limitation of liability that applies to all losses and damages of any kind (whether general, special, consequential, incidental, exemplary or otherwise, including, without limitation, loss of data, income or profits), whether in contract, negligence or other tortious action, even if an authorized representative of HomeManager has been advised of or should have known of the possibility of such damages. If you are dissatisfied with the site or any content on the site, or with this agreement, your sole and exclusive remedy is to discontinue using the site. You acknowledge that your use of the site is at your sole risk. If applicable law may not allow the limitation of liability set forth above, so this limitation of liability may not apply to you.

Your information :

The information we collect from you is not sold with your identification to any third party.

Aggregate information and data :

Aggregate information is used for trends, statistics and giving our members a benchmark on how they are doing in relationship to other member users. This information is aggregated for research and membership use.

Insurance Industry :

We have been working with the insurance industry for creating a discount program for members who want to opt in for additional discounts. THIS IS AN OPT IN ONLY PROGRAM AND YOU WILL BE NOTIFIED IF YOU WISH TO OPT IN TO RECEIVE DISCOUNTS.

Data tracking :

There are different sources we use to verify users, locations, times, dates as well as what the industry calls cookies, which time and GPS stamp uploaded data. We use this information to help personalize your online experience. These are uniquely assigned to you and can only be read by our web’s server/s in the domain that are unique to you. If you do not want the information feedback you can modify your browser settings to decline this information tracking. However, before you deactivate, we want to let you know that you may not realize the full benefits of membership with cookies disabled.

Third Party sites :

HomeManager, throughout its site, may link to third-party websites such as: the Energy department, Fire and Rescue, FEMA.gov, Insurance Institutes, and many others great agencies and organizations with great information for keeping your family healthy and safe. HomeManager link to these website does not create or imply any relationship between HomeManager and these organizations or websites.

Enforcement of terms, conditions and policy :

By accepting the terms of this agreement users agree that their access and use of the membership, site, website, web app, mobile app or other communication through HomeManager and any legal action undertaken pertaining to the terms of this agreement shall be governed by the substantive and procedural laws of the state of Montana. Any dispute regarding this agreement or an alleged breach of this agreement by either party shall be first the subject of binding arbitration in the state of Montana. If the dispute cannot be resolved through binding arbitration, the parties agree that the venue of any legal action regarding this agreement shall be the Sixth Judicial District of the State of Montana.

Professionals :

The appearance of professionals on the HomeManager website shall not be construed as an endorsement or recommendation of any professional who appears.

Changes to this Policy :

HomeManager reserves the right to modify or amend this Policy at any time by posting the amended Policy on this Site. All amended terms take effect upon posting. Each time you use the Site, the current version of the Policy will govern your use. Accordingly, when you use the Site, you should check the date of this Policy (which appears at the top) and review any changes since the last version.

Any information that you enter into your data file is subject to HomeManagers terms and conditions above. By using any of our sites you agree to be bound by the terms, conditions, and policy of HomeManager and our affiliates.
